Refund policy

Right of Withdrawal

You have the right to withdraw from this contract within one month without giving any reason. The withdrawal period is one month from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (Eminia Trading GmbH, Gernotstrasse 16, 44319 Dortmund, Germany, e-commerce@eminiatrading.com, telephone: 02318868082) of your decision to withdraw from this contract by means of an unequivocal statement (e.g., a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, but it is not mandatory. You may also exercise your right of withdrawal online at https://account.eminiashop.com. If you use this online function, we will immediately send you an acknowledgement of receipt on a durable medium (e.g., by e-mail) containing information on the content of the withdrawal notice as well as the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; You will not be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal does not apply to the following contracts:

Contracts for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.

Special notes
If you finance this contract with a loan and subsequently withdraw from it, you are no longer bound by the loan agreement either, provided that both contracts form an economic unit. This is particularly the case if we are also your lender or if your lender utilizes our services in connection with the financing. If the loan proceeds have already been received by us at the time the revocation takes effect, your lender shall step into our rights and obligations under the financed contract vis-à-vis you regarding the legal consequences of the revocation or the return of the goods. The latter does not apply if the contract in question concerns the acquisition of financial instruments (e.g., securities, foreign currency, or derivatives).

If you wish to avoid a contractual commitment to the greatest extent possible, you should exercise your right of revocation and also revoke the loan agreement, provided you are entitled to a right of revocation for that agreement as well.
