General Terms and Conditions

1. Scope

The following General Terms and Conditions (GTC) apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person, or a partnership with legal capacity, that acts in the exercise of its commercial or independent professional activity when entering into a legal transaction.

In relation to entrepreneurs, the following applies: If an entrepreneur uses conflicting or supplementary General Terms and Conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly consented to them.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Eminia Trading GmbH.

By placing products in our online shop, we make a binding offer to conclude a contract for these products. You may add our products to your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation via email.

3. Contract Language, Storage of Contract Text

The language(s) available for the conclusion of the contract: German.

We do not store the text of the contract.

4. Delivery Terms
Delivery Options

We ship products to the delivery address provided during the ordering process.

We deliver exclusively via shipping. Self-collection of the goods is unfortunately not possible.

5. Payment
5.1 Prices

The prices indicated at the time of the order shall apply. These are total prices and include statutory value-added tax (VAT).

5.2 Payment Methods

In our shop, the following payment methods are generally available to you:

Advance Payment (Prepayment)
If you select the advance payment method, we will provide our bank details in a separate email and dispatch the goods upon receipt of payment.

Credit Card
You provide your credit card details during the ordering process. Your card will be charged immediately after the order is placed.

SEPA Direct Debit
By placing an order, you grant us a SEPA direct debit mandate. We will notify you of the date on which your account will be debited at least one banking business day in advance (a so-called "prenotification"). A banking business day is any working day, excluding Saturdays, nationwide public holidays, and December 24th and 31st of each year. Your account will be debited before the goods are dispatched.

Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have the Apple Pay feature enabled, authenticate yourself using your login credentials, and confirm the payment instruction. The payment transaction will be processed immediately after the order is placed. Further information will be provided during the ordering process.

Google Pay
To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have the Google Pay feature enabled, authenticate yourself using your login credentials, and confirm the payment instruction. The payment transaction will be processed immediately after the order is placed. Further information will be provided during the ordering process. PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself using your login credentials, and confirm the payment instruction. The payment transaction will be processed by PayPal immediately after the order is placed. Further instructions will be provided during the ordering process.

PayPal may offer additional payment options within the customer account to registered PayPal users, selected based on its own criteria. We have no influence over the provision of these options; any such individually offered payment methods concern your legal relationship with PayPal. You can find further information regarding this in your PayPal account.

6. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal, as described in the instructions on the right of withdrawal. No voluntary right of withdrawal is granted to business customers (entrepreneurs).

7. Transport Damage
For consumers: If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failure to file a complaint or make contact will have no consequences for your statutory rights or their enforcement—specifically your warranty rights. However, doing so helps us assert our own claims against the carrier or the transport insurance provider.

For business customers (entrepreneurs): The risk of accidental loss or deterioration of the goods passes to you as soon as we have handed the items over to the freight forwarder, carrier, or any other person or entity designated to carry out the shipment.

8. Warranty and Guarantees
Statutory Liability for Defects
The statutory provisions regarding liability for defects apply.

Information for Consumers

When purchasing goods, the statutory warranty period is at least two years. Regarding the warranty for goods, please also refer to the harmonized notice provided in accordance with Implementing Regulation (EU) 2025/1960 (the so-called "warranty label"). Guarantees and Customer Service
Information regarding any additional guarantees that may apply, along with their specific terms and conditions, can be found on the respective product pages and on dedicated information pages within our online shop.

9. Liability
We are always liable without limitation for claims arising from damages caused by us, our legal representatives, or our vicarious agents in the following cases:

in the event of injury to life, body, or health;
in the event of an intentional or grossly negligent breach of duty;
in the event of a guarantee (where agreed upon); or
where the scope of the Product Liability Act (Produkthaftungsgesetz) applies. In the event of a breach of essential contractual obligations—those whose fulfillment is a prerequisite for the proper execution of the contract and upon whose observance the contractual partner may regularly rely ("cardinal obligations")—caused by the simple negligence of ourselves, our legal representatives, or our vicarious agents, our liability shall be limited to the amount of the damage that was foreseeable at the time the contract was concluded and which is typically to be expected.
All other claims for damages are excluded.

10. Dispute Resolution
We are neither obligated nor prepared to participate in dispute resolution proceedings before a consumer arbitration board.
